Overview

The following short essay assignment is designed to help prepare you for an important part of the Final Paper. In this essay, you will do the following:

  • Choose either the same ethical question you formulated and introduced in the Week One Assignment, or a different one based off the list of acceptable topics.
  • Choose either utilitarian or deontological ethical theory to apply to the ethical question.
  • Explain the core principles of that theory.
  • Demonstrate how the principles of the theory support a certain position on that question.
  • Articulate a relevant objection to that position.

Instructions

Write a five-paragraph essay that conforms to the requirements below. The paper must be at least 1,000 words in length (excluding title and reference pages) and formatted according to APA style as outlined in the Ashford Writing Center. The paragraphs of your essay should conform to the following guidelines:

    • Introduction

      The introduction should clearly state the ethical question under consideration, and define the essential issues. You may build upon the question and introduction you provided in the Week One Assignment; or you may choose a different question, but it must be based off the list of acceptable topics. Your introduction should include a brief remark about the kind of theory you will be using to approach this question. The last sentence of the introduction should briefly summarize the or position on the issue you think is best supported by this theory and succinctly state what the objection will be. Bear in mind that your essay will not be concerned with your own position on this issue, but what someone reasoning along the lines of the chosen theory would conclude; this may or may not be the position you took in the Week One Assignment.

 

    • Body Paragraphs

      Each paragraph in the body should start with a topic sentence that clearly identifies the main idea of the paragraph.

        • Theory explanation

          Explain the core principles or features of the deontological or utilitarian theory and the general account of moral reasoning it provides.

          You must quote from at least one required resource other than your textbook that defends or represents that theory. Refer to the list of acceptable resources.

        • Application

          Demonstrate how the principles or features of the deontological or utilitarian theory apply to the question under consideration and identify the specific conclusion that results from applying the reasoning characteristic of that kind of approach.

          Your application should clearly show how the conclusion follows from the main principles and features of the theory as addressed in the previous paragraph. Please see the associated guidance for help in fulfilling this requirement.

      • Objection

        Raise a relevant objection to the argument expressed in your application. An objection articulates a plausible reason why someone might find the argument problematic. This can be a false or unsupported claim or assumption, fallacious reasoning, a deep concern about what the conclusion involves, a demonstration of how the argument supports other conclusions that are unacceptable, etc. You should aim to explain this objection as objectively as possible, (i.e., in a way that would be acceptable to someone who disagrees with the argument from the previous paragraph).

        Note that this does not necessarily mean that the objection succeeds, or that the conclusion the theory supports is wrong. It may be an obstacle that any adequate defense of the conclusion would have to overcome, and it may be the case that the theory has the resources to overcome that obstacle. Your task here is simply to raise the objection or present the “obstacle.”

 

  • Conclusion

    The conclusion should very briefly summarize the main points of your essay.

The Exclusionary Rule

Defendants in criminal trials have one main weapon to prevent their conviction before trial. That weapon is called the Exclusionary Rule. The Exclusionary Rule holds that evidence obtained through a violation of a defendant’s constitutional rights is inadmissible at trial. This primarily applies to Fourth Amendment search and seizure. Further, the evidence obtained illegally may make inadmissible other evidence obtained from the original evidence (i.e., the fruit of the poisonous tree doctrine). Therefore, it is important for all judges, lawyers, police officers, and other legal professionals to understand the nuances of this fact-intensive rule.

Review Chapter 3, § 3.1 and 3.2, in your course text, Constitutional Law, and focus on the fundamentals of the Fourth Amendment.

This assignment is not an essay but an exercise that helps build toward your Final Paper for the course. Your task in this assignment is to construct the best argument you can for a position on a controversial topic. Your argument should be your own creation. You may take inspiration from other arguments, but the formulation of the argument you present should be original to you.

 

Prepare:

 

  • Begin by choosing a topic from the list.
  • Construct an argument for a position on the topic. This is the position that you will defend in your Final Paper. Make your argument as high quality as possible: In particular, make sure that all of your premises are true and that the truth of the conclusion is demonstrated by your premises.
  • Consider possible objections to your argument, and revise it several times until you have an argument that is as strong as possible.
  • Search in the Ashford University Library for quality academic sources that support some aspect of your argument.

It is important for those who have an interest in the criminal justice system or in law enforcement to learn about some of the challenges working in a litigious society can create. Criminal justice agencies have developed methods to reduce the chances of incurring lawsuits against their officers and departments. You will glean valuable insight and learn how to begin developing clear, concise, and substantive communication necessary for criminal justice and law enforcement officers.

In this LASA, you will create a 15–20 slide PowerPoint presentation and write your script from the perspective of one of the following roles in Centervale: an internal affairs investigator, compliance officer, or similar official seeking to mitigate and improve the department by reducing the number of legal actions filed against the department. You have been asked to do this presentation in response to the following scenario:

It is common to see groups of youths hanging around various locations in Centervale. A group of mischievous juveniles hang out at a 24 hour Burger Joint on Tenth Street on a fairly regular basis and often get into Saturday night scuffles with other groups of juveniles, which require the police to respond to clear the area. The owner of the Burger Joint has become increasingly concerned about a drastic decrease in sales; however, he continued to look the other way until the scuffles escalated into full-blown fights that involved weapons, such as knives or brass knuckles.

Recently, the owner of the Burger Joint called 911 in a panic because he thought he heard gunshots fired from the parking lot area during a scuffle. Officers from the Centervale Police Department (CPD) arrived on the scene to find several youths involved in a physical fight provoked by a verbal attack, but there were no visible signs of weapons. Officer Jack Newbie just completed Taser training at the Centervale Police Academy. Officer Newbie believes carrying a “non-lethal” alternative to a firearm is beneficial for law enforcement officers.

Officer Newbie and his partner proceeded with caution when attempting to break-up the fight at the Burger Joint because reports of weapons involvement can create very dangerous situations for officers as they approach. Sam White, 15 years old, who was not actively involved in the physical aspect of the scuffle, tried to flee from the scene. Officer Newbie did not give verbal commands before firing his Taser at White as he fled. The Taser’s 50,000-volt of electric shock caused White to go into cardiac arrest upon impact, but he was revived on the way to Centervale Memorial hospital. White’s girlfriend, Rosey Green, a small-framed female, who was visibly showing signs of pregnancy, was distraught and angry over White’s condition. Green jumped onto Officer Newbie’s back, bit him on the neck and punched him in the ear. Officer Newbie’s partner, Officer Joe Flash, Tased Green during the assault. Later that evening Green had a miscarriage and lost her baby. Green and her parents are now suing the CPD for use of excessive force against a minor.

In your presentation, explain how Green’s behavior, the facts of the case (i.e., dispatch: fight with weapons), and Officer Newbie’s response align or misalign with the terms of the policy.
  • Create a mitigation action plan (MAP) that contains three recommendations supported by the findings of current empirical research that might help to reduce the number of lawsuits that could be potentially filed against the CPD.
  • Does the definition of a frivolous lawsuit apply to the situation with Officer Newbie and his handling of the White Case? Analyze and discuss how a potential lawsuit filed by White against the CPD might be perceived by the court and how the CPD might mediate or litigate a lawsuit of this nature.

Choose one (1) of the three (3) reading selections from the list of topic choices below. The focus is on brief but important primary source material written by major authors. Read the selections  as identified with each topic below. Write a three to four (3-4) paragraph essay (250 words minimum) which analyzes the “surprise ending” of the reading selection.

  • Reading selection from Descartes’ Discourse on the Method (Part IV). Descartes begins with a  proof of one basic conclusion and ends with a proof of something much grander. Remember to focus on the surprise and point of realization, not the details of the philosophical argument. This is only four or five (4 or 5) pages of the larger work.
  • Reading selection of Swift’s A Modest Proposal. It is essential to recognize the genre of this work, as discussed in our class text, which you should consult and cite. Swift promotes a radical solution, but subtle options are mentioned. You are looking for surprise and a point of realization. Read and focus on A Modest Proposal located at http://www.victorianweb.org/previctorian/swift/modest.html.
  • Two (2) reading selections from Voltaire’s Candide. Consider how these readings start and end in terms of the action and the beliefs. You are looking for surprise and a point of realization. These selections can be found on pp. 840-841 in the textbook. In addition, consult the class text at pp. 824-825.

For the reading selection you choose:

  1. Clearly state in your own words the “surprise ending” in the reading you selected. Clearly identify the point in the reading when you realized that there were elements in the reading that surprised you. Not all of the surprises come at the end.

In this assignment take the role of the Vice President of Operations creating a mini-management plan that focuses on those aspects of the business related to planning and organizing.  As Vice President of Operations, Joseph Jackson, the leader of Cyber Software, Inc., has asked you to help him solve his organizational problems.  This mini-management plan is a professionally written document that will be given to Joseph Jackson.

In writing the plan, you should use the terminology learned in the course.  Since Joe Jackson is quite knowledgeable, you are not defining terms using a dictionary, but instead you will explain and describe Management concepts and theories so that Joseph Jackson understands what you mean. For example, why the concepts, ideas, and theories are important to the business and how to implement the proposed plan.  The plan is not one in which the Vice President of Operations tells Joseph Jackson that he should do this or do that, but rather one that is presented in an action-oriented manner.  Students are expected to make connections between the facts of the case study and Management concepts, theories, and ideas presented in the course readings.

The mini-management plan will structure the entire company and will cover Joseph Jackson’s organization’s mission, vision, structure and culture.

Step 1:  Review “How to Analyze a Case Study” under Week 3 Content.

Step 2:  Create a Word or Rich Text Format (RTF) document. This mini-management plan should be presented in a professional manner using double-spacing for the text in the paragraphs. The final product should be between 9 to 10 pages in length-excluding the title page, any diagrams or exhibits, and references pages.

Step 3:  Title page with your name, the course name, the date, and the instructor’s name.

Step 12:  Respond to the required elements of the assignment.  Be clear and concise in the writing and make sure the questions are comprehensively answered.

  1. Provide a brief management history of Cyber Software, Inc.;
  2. Help Joe Jackson by proposing a new mission statement and vision statement that align with what Joseph Jackson now envisions for his company;
    1. Explain why the new mission statement and vision statement are appropriate for Cyber Software, Inc.;
    2. Discuss other aspects of the planning phase that impacts Cyber Software, Inc.;
  3. Create an organizational structure that aligns with the vision of Joseph Jackson
    1. Structure the entire company;
    2.  Explain why the structure is the most appropriate structure for Cyber Software, Inc.;
    3. Discuss why other structures are not appropriate;
    4. Illustrate and discuss the new structure with an organizational chart with names, job titles, and direct reports.  Be creative but make sure the jobs fit into the allotted budget;
  4. Create an organizational culture that aligns with the vision of Joseph Jackson and his new organization structure;
  5. Explain how the new organizational structure and culture affect the planning and organizing facet of Joe’s business and prevent future mishaps.

Step 13:  Using the grading rubric as a comparison, read through the paper to ensure all required elements are presented.
