Prepare: Prior to writing your initial post, read Chapters 1 and 2 of American Government. In addition, watch the video provided on the U.S. Constitution,Episode IV – Built to Last.

Reflect: The U.S. Constitution is the cornerstone of our federal government. The Constitution establishes a basic operational framework that enables the three branches of government – executive, legislative, and judicial – to interact and function as a unit. Embedded in this operational framework are two key principles: separation of powers and a system of checks and balances.

Write: In your initial post, explain why the separation of powers and the system of checks and balances are important for our democracy. Provide recent, real-world examples of the separation of powers and checks/balances in action (one example each). Also, discuss how the Constitution protects individual and group rights. Again, provide a recent real-world example of these Constitutional protections being applied here in the U.S. You must fully respond to all parts of the prompt and write your response in your own words.Support your position with APA citations from two or more of the assigned resources required for this discussion. Please be sure that you demonstrate understanding of these resources, integrate them into your argument, and cite them properly. Your initial post should be 200 to 250 words and be written in complete sentences.

Describe one argument that supports the death penalty.

Capital Punishment has long been a controversial topic and has been used as punishment for crimes of murder and can be applies to crimes of treason, and espionage.  In the United States, “31 states, the federal government and the military still have the death penalty” (States With and Without the Death Penalty, 2015). Violent crime that take the life of people is considered the worst crime in America.  For committing that crime, in many cases the defendant will get the death penalty. Mass murder defendant “Jessie Dotson” of Memphis Tennessee “killed several relatives including his brother and toddler nephews” (Grinberg, 2010).  People like Dotson must receive the death penalty as it is important to send a message to society that this type behavior will not be tolerated and justice will prevail.  Also, proponents of the death penalty believe it deters crime, cost less than life imprisonment, and that the defendant will commit murder again in prison given the opportunity.

Describe one argument that opposes the death penalty.

Opponents of capital punishment believe it has no deterrent effect on crime, the state should not have the powder to take a human life as it cannot create life, and that the death penalty is discriminatory and unjust. In many executions, a lethal injection of “sodium thiopental” is used as an accurate means of inducing death.  However, this method came under fire in January of 2014 when the execution of convicted killer “ Dennis McGuire using a controversial new lethal injection took approximately 15 minutes, during which the condemned killer appeared to gasp and convulse” (Gangloff, 2014). This type of death is considered as cruel and unusual punishment which is covered under the “Eight Amendment” of the Constitution.

Explain which argument is the most credible, reliable, and valid. Why? 

As our world is surely becoming more and more dangerous, violent crime has become the norm, mass shooting are common and expected, and our prison system is already overcrowded, execution of our most violent criminals is justified in my opinion.  As I am a proponent of the death penalty, family members of victims need and require justice and this is why we have a judicial system.  Many families require retribution and justly so if the crime committed justifies the death penalty.

Describe one argument that supports “stop and frisk” policies.

For instance, analyze your classmate’s discussion of the difference between a reasonable and unreasonable search.  Is their discussion valid, well supported, and logical? Describe one argument that supports “stop and frisk” policies.

Crime in our major cities have become overwhelming for our police departments and new crime fighting tactics must be employed to bring violent crime under control.  Many major cities in all 50 states across the country have some sort of “stop and frisk” statute.  In Baltimore Maryland, it is called “Investigative stops.”  Stop and frisk laws has lowered crime in many cities across the country.  In 1990, New York had 527,257 victims of “serious crimes.” In 2011, there were 106,064. Murders dropped in that period from 2,262 to 504 (Smith, 2012).  In my book, these are numbers that work.  In 1968, the Supreme Court case “Terry v. Ohio” upheld a stop and frisk search conducted by a plainclothes police officer who observed three men who he believed were preparing to rob a store.  From the actions being carried out by the men, the officer believed a robbery was about to happen.  Under the “probable cause act”, the office stop the three men finding a gun on one.  

Describe one argument that opposes “stop and frisk” policies.  

Judge “Shira Scheindlin” a “United State Court Judge ruled that New York controversial practice of “stop and frisk” is unconstitutional, on the grounds that it unfairly singles out racial groups” (Resnick, 2015). In New York, there is evidence that crime decreased over a period of time.  However, there has not been any real research that can back up whether or not stop and frisk was the cause of the decrease in violent crime.  Crime actually stop and increase during certain periods without warning. According to the New York Civil Liberties Union, “Guns are found in less than 0.2 percent of stops. That is an unbelievably poor yield rate for such an intrusive, wasteful and humiliating police action. Yet, stop-and-frisk has increased more than 600 percent under Bloomberg and Kelly. And the rate of finding guns is worsening as the NYPD stops more innocent people each year” (Stop and Frisk Facts).   If these numbers are to represent the continuation of the stop and frisk program, the program could be considered a failure.

Explain which argument is the most constitutionally sound. Why?

The “Fourth Amendment” provide protection against unreasonable search and seizure. The Constitution does not explicitly cover stop and frisk laws, but it does promote the use of “Probable Cause.” Although probable cause is spelled out in the Constitution, it is still a gray area as what is a probable cause to one officer may not be to another officer.  This is where the problem arise with stop and frisk in my opinion.  It is true that police unfairly signal out people of color to stop and frisk and this is due to years of stereotyping by unprofessional police officers and this practice is not the practice of all officers. However, in the inner cities, crimes is running rampant primarily within the projects and red light districts areas. This is not to say other parts of the cities do not have crime.  Given my personal knowledge of how stop and frisk and probable cause should work as specified under the Constitution, I have to support stop and frisk policies.
